These Terms and Conditions ("Terms") govern your access to and use of the services provided by WAYART LTD ("Company," "we," "us," or "our"), including educational content, mentorship programs, community platforms (including Skool and Slack), digital materials, payment plans, affiliate programs, and any related services offered under the Trip Leader Academy brand.

By accessing, purchasing, or participating in any of our services, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Definitions

  • "Services": All educational content, mentorship, subscriptions, payment plans, community access, calls, materials, and programs offered by WAYART LTD.
  • "User" / "You": Any individual accessing or using the Services.
  • "Community Platforms": Third-party platforms such as Skool and Slack.
  • "Content": All videos, documents, templates, frameworks, recordings, and proprietary methods provided by WAYART LTD.

2. Nature of Services & No Travel Agency Disclaimer

  • WAYART LTD is a training and coaching academy only.
  • We provide education, mentorship, and community access.
  • We are NOT a travel agency, tour operator, accommodation provider, or event organizer.
  • We do not sell, manage, insure, or guarantee any trips, retreats, or events.
  • Any trips or experiences hosted by users are independently organized by those users.

You acknowledge that:

  • You are solely responsible for obtaining necessary licenses, insurance, permits, and ensuring tax and legal compliance in your jurisdiction.
  • WAYART LTD bears no responsibility for the safety, legality, execution, or outcomes of trips hosted by users.

3. No Guarantees & No Earnings Disclaimer

  • We make no guarantees regarding income, profits, bookings, or business success.
  • Any earnings examples provided are illustrative only and do not constitute a guarantee of future performance.
  • Your results depend on personal effort, experience, market conditions, and external factors. You expressly agree that WAYART LTD shall not be liable if expected results are not achieved.

4. Payments, Memberships & Payment Plans

Payments are processed through Skool, Systeme.io, Stripe, or other approved processors.

  • a) Monthly Membership: This is a recurring subscription billed automatically. You may cancel at any time. Access remains until the end of the current billing period. No refunds are provided for subscription fees already paid.
  • b) One-Time Programs & Mentorship: Access is granted upon successful payment.
  • c) Payment Plans: We may offer payment plans in up to two (2) installments. By choosing a payment plan, you agree to complete all scheduled payments. Failure to complete payments may result in suspension of access and collection actions. Payment plans are not subscriptions and cannot be canceled once initiated.

5. Cancellation & Refund Policy

  • Mentorship Programs: Eligible for a 14-day money-back guarantee, unless otherwise stated at the time of purchase.
  • Monthly Memberships: Non-refundable. You may cancel at any time to avoid future charges.
  • Payment Plans: Non-refundable once the first payment has been processed.
  • Exclusions: Refunds will not be issued for failure to use the services, partial participation, or breach of these Terms.

6. Intellectual Property Rights

All Content is the exclusive intellectual property of WAYART LTD.

  • License: You are granted a limited, non-exclusive, non-transferable, revocable license for personal use only.
  • Prohibited Uses: You may not share, resell, sublicense, or distribute Content; reproduce or modify Content for commercial use; or use Content to create competing coaching programs or academies.

7. Community Conduct & Access

By joining our community, you agree to act professionally and respectfully. We reserve the right to remove users or content at our sole discretion, without refund, for:

  • Harassment, bullying, or disruptive behavior.
  • Spamming or "poaching" members for competing services.
  • Violating platform-specific rules (Skool/Slack).

8. Affiliate & Referral Programs

Participation is optional. Commissions are paid only on valid, completed, and non-refunded purchases. We reserve the right to modify commission structures or terminate participation in cases of fraud or policy violations. Affiliates are independent contractors, not employees.

9. Limitation of Liability & Indemnification

To the maximum extent permitted by law, WAYART LTD shall not be liable for any indirect, incidental, or consequential damages related to your business operations or trips you host. You agree to indemnify WAYART LTD from any claims arising from your use of the Services or your actions as a trip leader.

10. No Class Actions

You agree that any dispute shall be conducted on an individual basis only. You waive any right to participate in a class action or join claims with other users.

11. Termination

We may suspend or terminate access for breach of these Terms or conduct harmful to the community. Termination does not affect outstanding payment obligations.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the courts of Cyprus.
